Denied Social Security Disability Benefits in Colorado

If you were denied Social Security disability benefits in Colorado, you are entitled to file an appeal. After the Social Security Administration (SSA) has considered your application, it will send you a denial letter which will provide the reason for being denied Social Security disability benefits and the last date you have for filing an appeal.

There are several reasons why you may be denied disability benefits but often the most important one is that the medical evidence you have provided doesn’t clearly indicate your disability prevents you from working for at least 12 months. If you fail to file your appeal before the deadline date on the letter of denial you won’t have the chance to appeal later on.

Filing an Appeal for Social Security Disability Benefits in Colorado

You can start the appeal process as soon as you have received your denial letter. The first step of the appeal’s process is asking for a Request for Reconsideration. The denial letter will tell you when and how to start the process and the last date for the Request for Reconsideration.

Colorado ALJ Disability Hearings

If, after your Request for Reconsideration has taken place and your claim for disability benefits is still denied, you still have another appeal you can file. This would mean having your case heard in front of an Administrative Law Judge (ALJ.) You will be informed of the date of the ALJ hearing and will be asked to bring any evidence with you which supports your claim for disability benefits.

The ALJ's main responsibility is to assess the evidence that a disability applicant can provide which helps to support their side of a case.  The ALJ will make a decision based on the evidence provided and could reverse the decision made at the Request for Reconsideration.

The ALJ may request that experts on the applicant’s medical condition attend the hearing so that they can be questioned about the applicant’s disability and whether it prevents the person from working for at least 12 months.  Not long after the ALJ hearing has taken place a decision will be made.
