Unfortunately, it is not easy to win a claim for a Social Security Disability benefit from the Social Security Administration (SSA) in the state of Washington and many applications are denied after the initial application. However, the SSA gives you the opportunity to file an appeal but there is a time limit from the date of the denial letter to lodge this appeal. This means you shouldn’t delay filing your appeal as soon as you receive the letter of denial.
Filing an Appeal For Social Security Disability Benefits in Washington
When you receive the denial letter you should file a Request for Reconsideration. This is when the SSA appoints an officer who hasn’t seen your application before. This person considers any additional evidence you may have provided which supports your application for a Washington social security disability benefit.
When you receive the denial letter it will tell you the deadline date for filing your request for reconsideration. It is normally 60 days. If you still receive a denial after reconsideration has taken place the next step is seeking a hearing with an Administrative Law Judge (ALJ).
Washington ALJ Disability Hearings
The ALJ will review your medical record at a hearing and will listen to any testimonies from reliable witnesses concerning the severity of your medical condition and any further medical evidence you have brought to the hearing. The ALJ's decision isn’t influenced by the fact that your case was denied at the time of your initial application and also at the reconsideration stage.
After you have submitted your request for an ALJ hearing, your local Washington State office will send you information about the hearing process, and a notice stating the time, date and place where the hearing will take place.
