Waiting for decision

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

I've applied for SSI 3 times already and all of the 3 times that I'd apply for were denied. So this last time I went and spoke to an avocate at the Social Security office where they did help me get the doctor appts that I needed to determined if I qualified for SSI. My appts were back in Jan. 2016. Dr said that I do qualified for of and also for SSD. I've been having seizures since 1991when I turned 21yrs old was the first time that I was diagnosed of being epileptic. So I'm still waiting for answer. I've worked for the gorgecy store VONS for 16yrs. Lost my job and haven't work since. So please let me know how long does it take to get an answer or send me the phones numbers of whom I'm suppose contact. It's been 7mos and still waiting for a decision. Thanks you, Teresa.

My ALJ called my lawyer and asked if I would be willing to change my onset date to when I turned 50. I said yes naturally, I lose 2 years of back pay. What do you think my changes of getting approval?

That is a real shame, but your chances of getting approved should dramatically increase if you change your date of onset like that.

Angela,
The change in onset date if you said yes took away your backpay beyond the date you agreed to. If not too late tell your lawyer you changed your meind unless this benefits you somehow? THey did this in order to get out of paying you back pay or at least normally thats why they do this. If you were disabled back then and can prove it just hang on and fight. Ask why the judge did this and ask your lawyer if it will make the difference of yes or no and why it would make such a difference. Social security doesnt want to help anyone out they want to keep your money. Make them do right. I am NOT a lawyer I am just a person going through this as well its been 7 years since I filed. Just finally won my case last month so I know what you are going through. Do not give up your benefits if you do not have to.

how do you get backpay from SSA? i thought they would only pay you back to the date you filed? or is it up to one year before?

Hi Neil,
The SSA would pay back pay from the Established Onset Date, which is when the SSA recognizes that you have become disabled.

Hello Neil I was informed by my attorney that they only do back pay for 12 months. But in some cases the judge can order more back pay. But most cases is only 12 months!

We had a hearing for my son who is 14 April 27th 2016. Who was diagnosed with Type 1 Diabetes, severe depression, ADHD and asthma. The judge has made a decision and I was told my sons case was with a underwriter. So is that a good sign or bad? And what are my chances of my son's case being approved?

I wouldn't be able to say exactly, but what may be happening is that the judge is writing a decision regarding your son's case.

I called Alj hearing office they told me decision was made. They told me that it was in the writing stage. I want to know what does that mean? How long before I recieve a decision letter. My appeal was on June 8 2016

I would not be able to say how long it would be until you receive your decision, however the judge in your case may be writing his decision.

Mine is at the writting stage. My Dr said I was unable to continue my jb the very at the hearing didn't have a job for me and it lasted 1hr 20 min. The jus told the VE man I could do two jobs so bring it down to two's I had to stand couldn't sit any longer. Then the judge said ok we in agreeable let's wrap it up. And told me to keep watch on the mail he will be sending me some papers.I've had three back surgeries ,bulging disc, arthritis, and degenerative spine ,nerve damage,and off balace I went to court March 11,2016 still waiting what u think do u think I have a good chance of approval had 4 surgeries since first denied. It's moving pretty fast

I called today my decision is back at the writting stage second time .the vocational expert said he has no jobs for me .Sept 11th will be 6 months what are my chances I wrote to u before can it still be a approval
