I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

My son is not but I did tell them he doesn't permanently live with me. Does getting that letter though mean disability will be approved?

Hi Pam,
As we are not affiliated with the SSA and I am unaware of the contents of that letter, I could not say.
My ex was involved in a car accident less than a month after we separated (April) and he broke his hip. We had our child support hearing and since he is out of work he pays nothing and owes nothing until he either goes back to work or receives disability. His paperwork from the doctor says he'll be out of work for at least 9-12 months. Plus he may not be able to perform the physical requirements of his job as a forklift operator after that time. We are not on good terms and he is barely involved in our children's lives. I'm struggling to get by as single mom of 3. Am I able to apply for benefits for the children under his social (I know the number because we did taxes together)? It's hard to obtain information when we are not together and I'm not the injured person. Also, what if he did apply and is keeping the money that is meant for the children? We have a custody hearing tomorrow and I am seeking sole custody because of his lack of involvement.

Hi Adrienne,
If he did apply, you can contact the SSA and inform them that you would want another payee for your children, rather than having your ex receive the money.
Hello my daughter father receives ssi and I was told that she could not get benefits off of him unless she was disable herself, she 10 years old now and she has ADHD and ODD and he's not entitle to pay child support, do you think that she could get her own money from her disabilities.

Hi Regina,
She may be able to if you are able to meet the income and financial resources limits for SSI.
My husband was approved for SSD after 2 yrs of trying. He had continued to pay child support during the 2 yrs he was unemployed. He is a retired Veteran with 100% disability. He is now approved for SSD and during that time our son has turned 18 but he is a senior in high school. Now, the back pay and benefits will go solely to our son but the husband is still paying the $518 automatic allotment/court ordered child support and the ex is saying that she should get the back pay and benefits and support so she can help pay her portion of him living in the college dorm. We pay support, medical, dental, school uniform,car/insurance and will pay the college tuition to include books and meals. I do know that because he is 18 he will recieve the back pay and benefits. The pressure is on him because of his mom. The lawyer explained that back pay to our son is child support during the time of the husbands unemployment??? Why are we not recieving the back pay not the full amount but the amount that would match the 518 for the last two yrs? He will recieve about $800 a month from SSD and the $518 to his mom.

Hi Pamela,
I really wouldn't be able to say as every state handles child support and benefits/back pay differently.
If I filed for my girls to receive benefits because their father is deceased and the worker told me how much they would receive a month and in back pay are they officially going to receive it or do they have to be approved first?

Hi Melissa,
The SSA may have to verify some information, but they may not need to be approved first.
If my grandson stays with me can he draw my disability benefits?

Hi Melissa,
If both his parents are deceased or if you adopt him, he may be eligible for benefits on your account.

Hi there,
if her father is receiving SSDI benefits, then she may be eligible for auxiliary benefits. Here's some more info on those:

Hi Danielle,
If approved, it takes about four months to receive benefits, and you child may be able to get back pay from the time the father was disabled.
