Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Kim,
In short, no, you would not be able to collect that disability money yourself, as you would not be eligible for benefits from your sister's work record. However, your niece may be eligible for benefit based off of her mother's work record.

I have been getting ssi and ssd for 3 years. I have tried several times to add my minor children to my case and was told because I get 150 in ssi my kids aren't eligible for a check. Also I recently applied under applied under my parents record being I've been disabled before 21 if granted is back pay given from the date of application?

Hi Rebecca,
Your children may still be eligible for benefits based off of your work history, though you may want to contact the SSA regarding that. Back pay is paid from the Established Onset Date (EOD), rather than the date of application.

Yes children who are eligible for auxiliary benefits may be eligible for back pay.

Hi the father of my child who is the non custodial parent just got approved for SSDI . Currently he pays me childsupport of $180 thru Childsupport Services which that amount is based off of his workers comp from his previous job that he is in a lawsuit with.... Since he now is approved to receive ssdi benefits and probably will not be receiving workers comp much longer my child receive benefits thru ssdi and child support or just ssd? As well will ssd pay the rears that he owes in child support?

Hi there,
Child support laws can vary by state, so I really cannot speak to how they would change your child support arrangements, but your child may be eligible for benefits from the father's SSDI benefits.

Your niece may still be eligible for benefits even if she is not in her mother's custody.

When my child was born, we noticed her vision wasn't going to be well. She does qualify for sure as blind but is now 5. Does payment start from her or will it be back pay?

They may be back pay for your child, it depends of what the SSA calls an Established Onset Date (EOD) for her disability.

My 5year old granddaughter is living with my daughter and son in law as legal guardian. Her biological father recently died. Can they receive social security benefits for her.

Hi Christi,
If you're eligible for SSDI benefits, your children would also be eligible for benefits if you're approved for benefits.

My question is, my step son's mother passed away..his mom had after passing away, was given disability.. when he started getting survivor benefits, his grandmother was told he'd keep getting survivor benefits until he was 18 yrs old or as long as he stayed in school.. that was just a little over a year ago.. today the grandmother gets told that there was a new law and that February of this year will be the last ck he'd get.. is that right??

Hi Sara,
If the child in question is over 19, they may not be eligible for benefits as the SSA's rules stipulate that benefits are provided to children under that age who are attending primary or secondary education.

I have a complicated situation. I have 3 disabled children that receive SSI. My ex-husband is now disabled and was awarded SSDI. This process took 5 years 3 months. 2 of my children received back pay of the same amount. I now received a letter from SSA saying that my third child will receive significantly less because she was receiving SSI during the 5 year + period. I'm so confused. My other 2 children where also receiving SSI and were awarded the full back pay amount. If anyone has any insight.... Thank you

Hi Melissa,
If you're on SSDI benefits, the maximum benefits that can be paid out is 180% of an individual's benefits. Generally a dependent will receive about 50% of a parent's benefit as their own, so it may be that your ex has hit that maximum with his own benefits.

My children receive SSI because they are disabled. My ex husband is now receiving SSDI because he is disabled. Your thought is that we reached the max payout, not any issues with the children receiving SSI as the letter states?
