Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

My Husband started receiving SSI benefits a couple of years ago. He owed child support for 3 of his children, which was about 80,000.00 for each child. After he was on SSI for about a year, his child support statements starting showing credits paid to the dept. He never made those payments but now all the support has been paid in full and he no longer owes since his children have reached 18. How does this happpen?

Hi Cynthia,
It's really hard to say as states have varying laws regarding child support and SSI, you may want to contact the office in your state that handles child support.

Hi Stephanie,
Unfortunately, SSI benefits do not include benefits for dependents, your child's father may want to contact the SSA regarding his payee, however.

Hi Virginia,

If his father is not currently receiving some sort of assistance such as SSDI or SSI then no. But he could qualify under your disability or on his own.

Hi Michelle,

It's really tough to say, since every case is different there is no black and white answer. But I would recommend to actively checking your account to see if there are any updates.

I received a partial ssdi decision. I had brain surgery and it took almost 4 years to get this decision. I always worked( education). I'm working with lawyers to figure out my next step as it was considered a closed period of finding me disabled. During that time period my only daughter would of been eligible ( I would imagine) as I met qualifications. I WANT to know if she would be able to draw for that time period ALTHOUGH.... Her biological father( lives in another state with brain cancer) has been disabled SSDI. For many years she drawed off him. He is still hanging on so can a child draw off, both parents with SSDI. However we were never married. Any info would be appreciated. Thank yoi

Hi Tina,
The SSA does not provide back pay for survivor's benefits, you may be eligible to receive them now, however you may not be able to receive any money for any time that you were eligible but did not apply for them.

Hi there,
The SSA may send benefits to them, however you may be the one required to manage those funds for them.

Partial approval SSDI FOR 16 MONTHS( said after surgery) I was back to normal( ha). Massive brain surgery. Question. Can a child receive past benefits on behalf of me her mother even if she was drawing off her father( ssdi )( FOR YEARS UNTIL HER 18TH.? DO I have a shot for her backpay or does a dependent only draw off of one parent? Not been with her father for 15 years? Help
