Disability and Healthcare power of Attorney

Submitted by Anonymous (not verified) on

My husband has health care power of attorney for his mom and he has filled out all information for her for the last year. She has a rare form of dementia and hasn't been able to do anything on her own in years. He's been dealing with the social security office for a year and now they are at the end and telling him they will only deal with her and who is in her direct care (meaning nursing home). This makes NO sense to me. He's done everything for them so far and now they are not wanting to discuss it with him because they said they don't go by the Healthcare power of attorney. Does this sound crazy to anyone else???

Hi there,
I'm sorry to hear about that! While your spouse may have Healthcare power of attorney, he may not have what's called "durable power of attorney". These two are distinct, and healthcare power of attorney may only extend to healthcare decisions.
