When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Help. Is been about 4 years since I applied for Disability & my battle goes on as my conditions get worse. I went before a judge who denied me, but my advocate took my case to an attorney who agreed the judge did not give any credence to my doctors care or opinions...so not I am waiting for the appeals council (I guess) to give me a decision. My advocate filed my disability date to 2007 which is when I stopped working. In your opinion is my outlook favorable, or not? I am 57, have ADHD, Personality disorder, major depressive disorder, extreme anxiety, panic attacks & agoraphobia. I feel my sanity slipping away and do not know how much longer I can take this. Would I actually get back pay back to the onset date?

You may be able to receive back pay from your established date of disability, however as we do not have any particular information about your case, we couldn't say one way or the other if your case would be favorable.

I applied about 4 years ago on my own for disability benefits based on my many issues. It became impossible for me to work at all about 8 years ago. My application was not approved. At this time I sought out a disability advocate to represent me. They filed the appeal which was denied. In truth I have been suffering from my conditions for over 30 years & have gone through a myriad of medications. My advocate listed my onset as 8 years ago when I could no longer work. The appeal filed through my advocate was denied. I have been under constant doctors care since I applied & also seeing a therapist. After the appeal was denied, my advocate set up a hearing with ODAR face to face with an ALJ, having a vocational expert on the phone during the hearing. When the hearing rolled around, all my doctors provided written opinions that I am unable to work & a list of my current medications. I felt so hopeful because of the strong support from my doctors & therapists & the fact my hearing was face to face with the judge & it would be obvious to him of difficulty to control my emotions or even comprehend the questions. I was subsequently denied, again. My advocate talked to an attorney who said we should send in a request for reconsideration based on the fact that the ALJ gave no merit to my doctors statements. The request for reconsideration was submitted to the appeals council 8 months ago. My mental health continues to deteriorate & I have been put on 4 additional drugs. It has been suggested to me by my doctor that when I need to, I go to treatment at a hospital, which scares me. What more can I do??? If I did not believe I needed disability assistance I would not have applied for it. I am at my wits end & feel like I am on the verge of another nervous breakdown. For the record, I am 57 years old. I really am at the end of my rope & desperate. Not sure how long I can take this.

Just an FYI, my wife waited 2.5 years after her disability to receive a judgement in her favor with date of disability going back to her accident. She received her lump sum 3 weeks after the judges ruling due to extenuating circumstances. Her father is in another country and passing away, her "case manager" or whatever he is referred to put her in for an emergency assistance disbursement but after reading so many of your stories, we were not hopeful. We are very grateful as she needs my daughter to travel with her and she will be able to see him, hopefully, before he passes. Thank you so much to this man for helping. Please don't expect this to be the norm. As I said, extenuating circumstances. I pray for you all to get the help you need.

I filed for disability in 2015 was denied so got a lawyer and he refilled it was receiving Ltd from work them 2 years April I had a hearing just received were I get it but no back pay I don't understand this at all. Please help me understand this.

You may not have been eligible for back pay if you had re-filed your disability application. You may want to contact the lawyer that was helping you with this for more information.
I recieved my first payment in january of 2017 backpay approved from Oct 2012 but actually may of 2013 (5 month) but not its coming up june and i called local ssa no word really just wondering if i ask for a manager to manager call to find out an update on this ..its really an anxious time right now due to my wife died last year and taking care of kids ..help pleas anything will do in advise..

I was just curious I was working part time while my ssd case was being reviewed, I made do little that social security did not count it as income. But I have been working since I was 18 until just recently just quit my job. Now that I'm not working anymore will that affect my upcoming payments from social security disability through the yrs. I'm 54 . I just found I was approved last week. :)
