Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

My husband just got approved for SSDI and was told he will receive a certain amount extra for our 9 year old son. We are also in the process of separating. Will the money go to my husband and be sent to our home (I will have full custody). Will I have control over it for him or will my ex husband?

Hi Molly,
The SSA may assign the custodial parent as the child's payee, however it's always good to contact the SSA regarding this as they can give you specific information about your case.

i just found out that ex husband is collecting ss bennefits for my son who is under 18. why am I not imformed? How can I know that ex is using money for our son? I have him one day more than he does and ex is recieving bennefits for son? Can I apply for my son? ex is 62, I am 57 ty

I have primary custody of my Daughter. But she moved in with her mom a little while ago . If she receives benefits under my disability . who will receive her support . will it come to me or her Mothers address .

You may still receive it, however it may be a good idea to make arrangements as to how both of you would use that benefit.

I am curious. I am the father of our 4 year old. I am disabled and just recently divorced from the mother. We received approval letters for me and our daughter, but my daughters approval letter came in the mothers name. I still receive both checks. Will I continue to receive both letters now? Does it matter that its directed to the mother? If not, is there any way to change the name to mine because I am the disabled person? Most importantly, our daughter spends equal time with both parents and we have joint custody. Thank you.

You may want to contact the SSA regarding this, if your ex wife is listed as they payee you may be able to change that.

Ive been caring for my nephew for the last few months, he has cerebal palsy and collected ssid up until a few years ago because his parents income no longer allowed him to qualify. We are unsure at this point if we will file for custody or adopt. My husbands income is pretty high.. .will his ccs, and medi-cal be taken away based on my husbands pay? and since we have decided to raise him due to the circumstances would he possibly be entitled to his ssid again or will thaey base it on my husbands income?

Hi Ann,

Your nephew's SSDI benefits would not be affected if you and your husband adopted him based off of your husband's income.

The SSDI program does not put a limit on the amount of assets or unearned income you have. However, the Social Security Administration (SSA) does put a limit on the amount of money that you can earn through work when you receive Social Security disability benefits, because if you can earn an income, you aren't considered disabled.

My 13 year old sons father has been collecting SSDI for several years. Our son has always lived with me, only visits his dad 4 weeks every summer. I just found out and reported to Social Security he has also been collecting $600 a month for my son, who lives with me. They immediately changed the Payee to myself! Can I get the money from Social Security that he collected on behalf of my son, without my knowledge, for all these years. I realize they will go after the father for fraud repayment, but how do I get all that money my son never received? Thank you.

Thank you Bryan. There is no way my sons father would ever give any money to me on his sons behalf. I thought I had read a blog somewhere that stated Social Security would persue the fraudulent payments with him, and due to their failure to find out about the fraud during their yearly recertification, provide my son with the funds they thought he was receiving. If i have temporary guardianship of my niece, and i receive SSDI, will my niece be considered a qualifying child under my benefits?
