Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

My boyfriend just got recently paralyzed. His dad recently got custody of him and his 17 years old. Can his mom still apply for SSDI and put it underneath her address when he doesn't live there anymore?

Hi my child is receiving disability benefits through his father his father had keeping all the money for himself while I had custody of him not knowing about the benefits once I found out I then filed for change of payee he got a significant amount of back pay for my child also he then went to court in the meantime and got primary custody it was 60 father 40 mother then probably about a year later I gained full custody and then that's when I filed for the change of payee from the time I had primary custody can I get back pay from the time I had custody till now since he didn't have the child

I'm sorry to hear about that! You may need to come to an arrangement with the child's father as the SSA would generally pay back pay only once.

If you become a representative payee but you have had custody of the child for over a year can you get back pay from the time you got custody if you didn't know about the disability payments

Hi Sally,
You would not be able to do so as those payments are for the child and they would have already received any back pay with their prior payee.

My childs father has been receiving benefits for my child's behalf childs father is disabled party also received a significant amount of back pay but the child has been living with me the whole time he only picked him up sometimes even though he has primary custody 60/40 60 father /40 mother only pays $50 a month in child support mother is on Cash Aid also food stamps is Mother entitled to any of the back pay whatsoever

Hi there,
You may want to contact your local SSA office regarding this, as you can have the payee for those benefits changed to someone who would use them for the child.

My ex gets ssi I believe. I hav a child by him will my son be able to draw off his ssi to ensure his support??

Hi Jessi,
Unfortunately, If he receives SSI, you would not be eligible to do so as SSI benefits do not include benefits for dependents.

My so recently passed. He was not married. Their mother has custody and they live with her. She constantly ask me to do things for the kids can I file for ssi for the as grandma?

You may be able to file for survivor's benefits on behalf of the children, you may want to contact your local SSA office.

My legal husband, I moved out many years ago, is collecting ssi disability. From fourth grade through eleventh our son lived with him. He had moved home and if attending his last year of high school hear in Missouri with me. How it can I file against his disability for our son?

Hi there,
You may want to contact your local SSA office regarding this, but your son may not be eligible for benefits as benefits for dependents stops at 16.

My fiance has just gotten a finalized divorce paper and his ex wife has a fiance, a brother that she claims for his disability so she's practically getting another income for taking care of her disabled brother and he has to pay her child support and their son has special needs so she's also getting another income from that every month as well.. is there anyway he can opt from child support? (Plus we have a baby together) That's about two incomes she's getting from the government (And she almost makes as much money as my fiance does/her ex husband)

You may want to consult your state's laws on child support as they vary by state.
