I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Son received back pay for his mother's ssi claim. He was an adult when he received the payment. Ca. state tax board put a garnishment against me for taxes on the money, yet I never saw any of it. His mother and I were divorced prior to her filing a claim. Franchise Board is not helping me, they just want $2500 and are going after my paycheck. Why am I liable for the taxes?

My husband's ex-wife receives disability benefits for their minor child. They have 50/50 custody. Do those disability benefits for the child count towards child support he would owe? We were told that he would only have to pay anything over the amount that the minor child is getting from SS. Or does that count as income for his ex-wife?

Hi Sarah,
You may want to consult your state's laws regarding this as how they handle SSI benefits and child support can vary.

If he did apply for benefits for your son, he may be admitting parenthood. H may be able to receive benefits for the child, however if you would like to confirm if your child is eligible, you may want to contact the SSA at 1-800-772-1213.

Hi there,
They would if the children would be eligible to inherit property from them. Generally if there is legal recognition of parenthood, that may be the case.
My daughter has been receiving benefits off of my husband (her stepdad) for the last 4 yrs. Although her biological dad has been fighting to get benefits for the last 3 yrs and just got approved and wants to now add her to his benefits so that they will back pay his child support how does this work? Will they back pay her if she's been drawing benefits from my husband during that time? Or will they try to make us pay back the money we have already received on her during this time if I allow her biological dad to claim her? She lives with myself and her stepfather. We would lose $200 a month if she switches and will they back pay her for all 3 yrs?
