When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Went to court judge said approved as of January 2014 for ssi and ssd then received letter saying I was approved for ssd as of July 2014 by ssa . The ruling was Dec 2015. Received 2199.00 and my first payment March 1rst and march 3rd. Now wondering where my back pay is for ssd. Got a letter from attorney saying should be getting letter something about a off set what the heck is that. Just can't figure out why anyone can't hear directly from the payment center instead of calling the office ( they get the infirmation later so basically they know nithing. One offsets the other is what they told me. Can they rake my student loan from my ssd back pay?

Hi Lisa,
I'm not sure why it would be offset? And once your are approved for disability benefits, all student loans are forgiven. It may just be taking your payment center an exceptionally long time to process the check.

You do not need to apply for it, it will just be deposited into your bank account.
my husband applied for ssa in june,2015 and got an award letter letting him know he was eligible starting in December but would get his first check in January and he did but my question is: Is he intitled to back pay.

If he was approved in December and applied in June, then he will not actually be eligible for any back pay.
I applied for disability for my child in 2012 and was denied. I recently reapplied last month. I was told that they saw where he was denied in the system. If I am approved would he be eligible for back pay?

Hi Rose,
No you would not. This is because SSI back pay is only based on the time of the most application, not the time at which a disability started.
I filled in january i was in prison for 2 years im out now before i went to jail i was allready on ssd so i refiled. In the year januray 1916 off this year so im asking how long do i wait for my ssd to come and my back pay

Hi there,
If you are approved and you applied in January, I would expect you to hear back from the SSA in May, and then start receiving benefits shortly thereafter. As for back pay, I am not sure.
Hi my name is Gregory I applied for ssdi and did on April 27 2015 . I was denied two times so far, went in front of the judged on February 8th 2016 and I have not heard from them yet.is this a good or bad sing? I have to kids and I lost my hone car bank account just don't know what to do.

Hi Gregory,
If you were approved at your ALJ hearing, you should be entitled to at least a couple of months of back pay, assuming the ALJ determines that you were disabled when you first applied!
If the Social Security office is working on my SSDI to calculate how much I should get a month how long would it take for me to receive my check after that

Ok so I called SSA today and they said that the attorney process has been closed out and the only thing left was to be paid out the back pay any ideas on a time limit today is the 60 day mark...

I'm not getting any checks my wife's Dad passed away last year but he had gotten approved for back pay..so this money belong to my wife and brother.. it's supposed to be split between them this should be a very simple case with no issues but maybe I have read to many horror stories on here about how ssi and ssdi work seems to me the waiting period is long so you'll die and they won't have to pay anything. ..

Your daughter's back pay should show up around four months after her monthly benefits start, since she's got two monthly payments, I would say it the first installment would show up around two months from now.
So my question is can an attorney get more than 6,000?? They said they withheld 21,000 for attorney fee but would pay us what he doesn't get.does this mean he can get more than 6,000?? Thanks for all information...
