I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?
ex-husband said he just got approved for ssdi. He applied for our 2 kids for auxillary benefits for them. He & social security said the kids checks will be sent to him because he lied and told them he has custody of them. He doesn't. I do. He is going to spend the money immediately when he gets it, what is my recourse? I can take him to court, but the money will have been spent and I KNOW the court can't make a poor disabled man pay something back that he doesn't have. Social Security is no help. they said whichever parent applies first is where the check will go to. Please help.

Hi Donna,
That is generally the case, but if you feel your children's benefits would not go towards their care if their father is the payee, I would let the SSA know, they can assign a third-party payee to ensure that the children get their benefits.

I would not be able to say because I'm not sure what you agreed to as far as custody.
I am on permanent ss disability and my daughter get a benefit check, my girlfriend moved out and took my daughter will she still get her check from me and now her mother wants to have control of her money my daughter is 4 years old

Hi Richard,
Yes, your daughter may still be eligible to receive benefits off of your work record if she is still otherwise eligible. However, as long as you use those benefits for your daughter's benefit, it should be fine, and you would not need to change your daughter's representative payee.
I have custody of my 3 children.. there mother, my ex wife gets SSI benefits for a mental disorder are these children entitled to any benefits from SSI?

Unfortunately, SSI does not offer any benefits to the dependents of the person receiving it.
My ex husband and I are divorced. He is currently disabled and is going to be drawing disability. It was stated to him that he could also draw a check for the children. They do live with him, and we do not have any kind of custody in order but they do live with him full time. He states that in order to get there check he must have full custody? My question is this, can we have joint custody with him having primary? As I'm not willing to give him full custody? I'm not in anyway objecting to him getting it, just the full custody part of it..

Hi Angela,
He does not need full custody to obtain auxiliary benefits for your children, or to be their representative payee for those benefits. However, I would not be able to say what kind of custody arrangements you can have as I do not have much knowledge in the field of family law.
What if my child only had a parent child relationship with his not biological father dad nothing legally binding them but a babtism certificate can he recieve his Social security if his dad is deceased he is listed as dad on school records as well but not married not adopted

Unfortunately, your child may not be considered eligible for benefits based off of his father's work record. In the case of your child's biological father, he or she may be eligible for benefits based off of their record.
My question is that I signed forgive and forget papers on child support for my three kids. Thinking that we are living together and things would go smoothly plus he had to go to a heating about it and told me that it would go through ssi not them and shortly anther that got more distant till a blow up and he moved out how can I find out if he honestly did sign them up and it would go to me to take care of them? Currently my dad helps me and their father doesn't boundary to see them please help! Thank you

If your children are signed up for SSDI auxiliary benefits, then you can change their payee by contacting the SSA, their number is 1-800-772-1213.

Unfortunately, if your ex is getting SSI benefits, there are not extra benefits offered for dependents with those type of benefits.
If I am approved for SSDI benefits and list my two minor children on my application, will they still receive benefits even if me and my ex-husband have 50/50 legal and physical custody and neither one of us pay the other child support?

If they are otherwise eligible, they may be able to get benefits.
My son's father recently died. When I contacted SSI they told me that he had been on SSID since 2011. They said that my son would only receive 6 months back pay for the disability payments even though he was eligible to receive payments for the last 5 years. Is there anything I can do? He will receive survivor payments now. Also, the father had another child after my son and they said that they could not approve my son's claim until they find her too. How long do I need to wait and how can this happen?

Hi Carla,
I'm sorry for your loss. Generally, if your son is receiving benefits, it would take four months from the time he starts receiving benefits to get the back pay. Regarding how long it would take to find the other child, I'm not entirely sure as to how long that would take.
