I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Michelle, if the father of your son adds the child to his application, he may be eligible for back pay. In addition, you may be able to have his SSDI benefits garnished for back child support.
I have deeming questions
If my daughters father and I live together but pay bills seperatly and essentially have two households will his income be deemed for her ssi?
Will this change if he is paying me child support?
Is child support from my other children's father considered when deeming?
Is adoption assistance for my other children considered for deeming with my daughters ssi?

Hi Christie,
That is a very good question. Some of that income will likely count towards your daughter's income limit, but not all of his earnings. So if he makes 50,000 per year, not all of that will count against her. Child support is NOT counted as an asset against SSI. I cannot say for sure, but I would think that adoption assistance would be in a similar situation.
When they call a child a dependent does this mean they must live with you? What if you have supervised custody and they now reside with a grandparent? My child is under 18 as biologically mine. I give a very small amount(not court ordered) in child support each month but he isn't a financial dependent. I don't claim him on my taxes.

Hi Falon,
A child does not have to live with you to be a dependent, he or she just needs to receive some kind of support, whether that be physically or financially.

Hi Regina,
You should definitely set up an appointment at your local SSA office about this. You can do so by calling the SSA toll-free at 1-800-772-1213.

I am under 18, and receiving child benifts. What is the max I can earn with a job in a year and not having to pay back my benifts?

Hi there,
When you are receiving SSI, any income you earn will affect your SSI benefits. For every $2 you earn, $1 will be subtracted from your SSI payment. You can earn around $1500 per month before you lose your SSI completely.
I just found out my ex passed away and my children are due to receive death benefits. What I also learned is that he was collecting Disability for last 4 years, I was not aware of. I am not told the children apparently should have received benefits also but since he checked the box on his application that stated he had no children (rude) but he did. Now I am told oh well, I can not receive the back pay. I have never received a dime in support so this would go along way into paying off debt acquired raising 3 kids on one income. Is there anything I can do? He did list me as his past wife but did not claim his children.

Hi Karen,
Your children may not be eligible for survivor's benefits based off of his account if he was receiving income based-benefits, which do not allow for child benefits or survivor's benefits.
I'm 28 years old and my mom has been receiving benefits since I was at least 3, do I quality for back pay on the child benefit she could have received for me but didn't claim?

Hi Fawn,
You may not be able to receive back pay if your mother was getting income based-benefits like SSI as those do not include benefits for children.
I've been drawing ssdi for about 10 years and recently got re-married and now have 2 minor stepsons. Do they qualify for benefits since its much harder to raise them with my current monthly payment?

Hi Tim,
Congratulations!
Generally, if a dependent is able to inherit property from you, then they may be eligible for benefits.
Hello. My sons father receives ssd. We haven't been together since my son was 1. He's now 12. He lives in a different state then us. He pays 30 in child support a month. Can I draw off his ssd and get back payments?
In reply to Hello. My sons father by Tracey (not verified)
HI Tracey,
You may, but if your son's father is receiving SSI, then you would be unable to as those benefits are not offered by the SSA. If he is on SSDI, you and your child may be eligible for benefits.
Hi. My 6 year old son receives benefits. I was told that he wasn't even recieving his whole amount and i was wondering why aren't they giving him his whole amount?
