When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

Hi there,
It's true, the disability application process may take awhile. The average wait time is generally 17 months to see a judge the first time.

I was approved by the Judge July 26, 2016. Three days letter I got the award letter. Then August 6, 2016, my attorney said they got paid. Then Sept. 2, 2016 I had my interview at SSA and I rejected SSI. They said I would receive a letter in a few days letting me know when I would be getting my back pay. But as of today I haven't received anything. (I have received my first SS Monthly check). Does anyone know how much longer will it take to receive my back payment. Thank you in advance for all your help. God Bless.

Hi Curtis,
If you were entitled to auxiliary benefits based off of your father's work record, then you may be able to get back-pay because of that.
I was approved from a judge back in early April. I got my first check in May. I was told I might need a payee, I went to my local office and was told there I was ok to make my own decessions and I didn't need a payee. I waited will Aug and called in and was told the payee thing was hanging it up at the payment center. I told them I came in and they saw all the notes and forwarded that info to the payment center. That was month and half ago, I called last week and spoke to someone again and said the note that was placed to the payment center from last person was gone.(but they said some times the payment center deletes notes) So they said we cant release till your lawyer is paid. I told them he was waiting to be paid. They checked all notes and system and said nothing should be holding the release of the payment to lawyer and would send a request to payment center to pay my lawyer! and then they release me back pay. Is there anything else I can do? I have medical needs and need to have things paid up from past and its like everytime I speak to someone they say they leave and note and call back in a month! Only to be told same things again !? any help please

Hi Gary,
If you can give the SSA documentation of your urgent need for the money, they may be able to pay your back pay, or a part of it, more quickly.

My back pay for SSDI was approved. On my online SS page it says 10/4/2016. Does this mean it was mailed a couple of days ago?

Hi Alan,
You would generally receive back pay about four months from the time you start receiving monthly benefits.
I originally filed in 2012 was denied 4 months after I initially filed. We appealed it, got to have a hearing in 2013. I don't know if my lawyer appealed it or reapplied for me. But just had another hearing October 4th. The judge was very understanding of my illnesses. How long will it take to get a decision? And will the judge set a onset date for the original date ?
In reply to I originally filed in 2012 by Virginia (not verified)
Hi Virginia,
Seeing as you have already had a hearing, you may know what your onset date is or is not in the letter that the judge will send in the next few months.
Yes, There are limits on back pay. The Judge decides when you became disabled. 3 Years after my initial injury for me. I'm receiving benefits after working for 33 years. Got my first 4 months so far. NO Back Pay yet. 12 months is max. I have 10 months coming minus attorney's fees. they say it takes 120 days- WORKING DAYS- That IS== 6 Months! It's been 5 months for me and they treat me like, "Why are you Even Asking"??
