The definition of disability in Oregon specifies that you must be unable to work because of a medical condition. Technically, the definition of disability in Oregon is that a person must be unable to engage in substantial gainful activity due to a medical condition that is expected to last at least a year or end in death.
Substantial gainful activity means work that you can get paid for. So, if you are unable to do any type of work that you can paid to do in Oregon you may meet the disability standard.
If you are declared disabled, you may also qualify for other assistance. In Oregon, there are programs that assist disabled people with housing, food, medical care, and sometimes childcare as well.
What Disabling Conditions Qualify In Oregon?
A disabling condition is a physical or mental health condition that makes it impossible for you to work. The Social Security Administration lists all of the conditions that are considered to be disabling in a book called the Blue Book. To find out if your medical condition is in the Blue Book you can search the Blue Book on the SSA’s website. If you want to look through a hard copy of the book you can do that at your local SSA office.
There are more than 200 conditions listed in the Blue Book. To qualify for Social Security disability benefits in Oregon you will need to be able to prove that you have one of the conditions that are listed in the book. You will have to submit medical evidence showing that you meet all of the requirements that are listed for that condition.
In addition to the medical evidence that you submit, you will need to show that you have enough work credits to qualify for Social Security disability benefits. Work credits are credits that you earn from working. They’re based on your salary and the number of hours that you have worked.
The number of work credits that you need to qualify for disability benefits varies, but in most cases, you will need to have worked for at least five of the last ten years to qualify for disability benefits.
Types of Disability Benefits Available in Oregon
The Social Security Administration has two different types of disability benefits. But you can only apply for one type. You can apply for either SSDI or SSI, but not both.
Oregon Social Security Disability Insurance (SSDI)
Social Security disability insurance, sometimes called SSDI, is the disability benefit offered by the SSA to people who have worked before but can’t work anymore because of a medical condition. If you have worked in the past and have earned a minimum number of work credits you are eligible to be approved for SSDI in Oregon. The average monthly SSDI payment in Oregon is $1,459.64.
Oregon Supplemental Security Income (SSI)
Supplement Security Income is a different type of disability benefit offered by the Social Security Administration. If you were born with a disability or became disabled as a child, but now you’re 18 and you can’t work because of your disability you can qualify for SSI.
If you are a parent that has a disabled child your child also may qualify for SSI, if you are low-income. Parents whose total household income is below the SSA’s income can apply for SSI on behalf of their child. However, the money must be spent only on the child’s expenses, and you will have to document how the money is spent.
When you apply for SSI on behalf of a child you will also need to submit your tax return, pay stubs, or W-2s showing your income. When the child turns 18 you will stop receiving the benefit, and they will need to apply on their own.
State of Oregon Disability Programs
In Oregon short-term disability is available through private employers and through the state if you are employed by the state. Short-term disability coverage starts on the 31st day after you pay your premium. And you are able to start drawing benefits on the 8th day after you become disabled.
Long-term disability benefits are also available. If you qualify for long-term disability benefits you don’t have to choose between SSDI and long-term disability. You can receive both. But, the amount of your SSDI may be reduced in that case. The total of the two benefits can’t be more than your previous salary.
