Waiting for decision

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

I had my Hearing in August 2017, and was told my case is pending writing? Does that mean a Decision has been made? Say it will take 45 more days and then another 30 days, what does this mean?

Hi Patty,
If you have a disability representative he or she will actually be able to view your current claim status even if it's pending writing.

My friend was determined to have an IQ of 69 and has a hard time holding employment. She went to a hearing and was told she will be notified by mail if she is approved. She said the judge was mean to her. Why would that happen to a person who has a diagnosis of autism and deemed to have a 69 iq from an ssdi psychologist

Hi Rob,
I am not a disability examiner, but I believe your friend will qualify. An IQ of 70 or below always medically qualifies.

I've been denied 2 times went before judge in July 2017 and I'm waiting and waiting and waiting. We even sent a message to his office and still nothing .I got shot 5 times and I can't work what in the world. Im homeless now. I dont get it. I'll be half dead before this comes

Hi.
Questions.
I contacted my ODAR office, and they mentioned that my disability hearing has been postponed and the judge send the file to a Medical Expert.
Is this a good or bad sign ?
How long they will postpone my hearing ?
Why my attorney is not aware ?

I really could not say, they may need a medical expert to review your file to determine if you are eligible for benefits. I'm not sure why your attorney was not informed in this case.

Had hearing on 8/22/17, was told it went to the writer on 10/23/17, still waiting to hear what the decision is. Called the ODAR office they would not give any information over the phone, only said to call attorney. Once it goes to the writer, how long does it take to get a decision. Been 115 days since my hearing.

I'm sorry to hear that! It usually takes around 5 months to hear back regarding a hearing, so you should get word of your claim within the month! Your attorney will know first so you can always give his/her office a call.

I had my disability hearing 08/15/17. At the end of the hearing my lawyer and the judge spoke alone. My lawyer said the judge would approve but he wanted a letter from dr. backing up his decision. I gave my lawyer the letter a couple days after the hearing. I have still not heard anything. I am getting concerned that is has been so long even though he told my lawyer he would approve it. Is this a normal amount of time? Should I be concerned? I'm tempted to call the social security office but I don't know if that will affect the decision somehow, I guess I don't want to rock the boat.

I really could not say, every case is different and it may take varying amounts of time for your decision to be processed.

I had a hearing on September 12th 2017 the thing is my attorney told me they usually decide cases within 4 months. Now I see that is not the case as some of you have been waiting up to a year or more for a decision. This is very upsetting to me because my case is extremely complexed and goes back to 2003. It was my 3rd filing and ALJ hearing in almost 10 years. I fully won an appeal in supreme court going back to my original date of filing 2003 for both my SSI and SSD cases. The judge in my September 2017 hearing had a VE and medical expert, but after the medical expert declared me fully disabled since 2003 he dismissed the VE and ended the hearing. My attorney said I won everything going back to 2003 and told me that back pay I receive will be astronomical. But now I see that I can be waiting on the ALJ decision then the writer and settlement for more years. I am disturbed by this as I have fought them for nearly 15 years and have financially struggled without being able to work or make any income. My wife has worked 2 jobs for almost 16 years for us to survive and its not fair to her. The question is on an extremely complexed case like mine or any case for that matter. What is the very longest someone has waited for an answer and settlement and the monthly check. Am I in for more years? and is there any way to ask my lawyer to put a hardship rush on it? Appreciate any help. thanks

I went to my disability hearing on 12-18-2017. I have severe osteoarthritis, neuropathy, diabetes, hep c, anxiety, depression, severe uncontrollable high blood pressure, (on five bp meds), numbness in toes. And feet. They had like two jobs I may be able to do per them. But know I am not able. The judge stated that she will have my answer in February. What are my chances of receiving my disability.
