Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Mary,
This might increase your benefits! It will depend on if your family has reached your maximum of 180% of your partners' SSDI benefits. You can always contact the SSA representative who handles your case to learn a little more about how this will affect you.

My sisters husband passed away in a car accident and my sister is unable to care for their children so i have gotten custody the girl turned 18 and has gotten married both of the kids get a check from their father. Since she got married will her check will stop? am i correct? And if so will her part go to her brother who is 14?

Hi Vicki,
I'm sorry, I'm a little confused--was the 18 year old the one who was receiving checks on behalf of a deceased parent? If so, then yes, if she married at age 18 she is no longer eligible for survivors' benefits.

Hi Tammie,
Unfortunately, they are only eligible if their parents are both disabled or deceased, or if you've adopted the children.

My son gets disability benefits through his disabled father until he finishes school. But he turned 18 and still has year and a half before he graduates. Well they took his money without warning us,and we had to get forms filled out and sent in by school next day. How long will it take before we get his check back

Hi Deedra,
That is very odd! If you've reported this to the SSA, you should receive that payment shortly. He should be eligible until he's 19 years and 2 months.

Recently my sons grandfather who has been guardian for him for 3 years now . His papa told me he wants to adopt my son. That he is getting older and wanting more things. He also brought to my attention that he wants my son to be able to recieve his social security after he passes. He is 73 years old. I am not fighting hia grandfather nor do i suspect he is wanting to adopt my son for any other reason then to help and care for my son. Question is if i agree to the adoption and have.my parental rights termimated. When my sons grandfather passes away and my is still a minor. Will i be able to get my son back. Without him being award state.

But I took him to child support. DO I have to choose between child support and the Ssd. Because child support is until 21 and ssd is until 18

Hi Joe,
You may need to adopt your granddaughter for them to receive benefits based off of your work record.
