I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Melissa,
I had misread your earlier comment. Because your ex-husband started receiving income, your children's eligibility may have changed. Additionally, they may be eligible for benefits based off of your ex's work record.

Hi Brian, They were back payments. SSA did inform me that they were. But there is a large discrepancies between what 2 of the children received to what the 3rd did. SSA originally sent a letter stating that daughter #3 would be receiving the same amount. Then I received a letter saying it would be significantly less because she was receiving SSI. All three of my girls receive SSI, as they are disabled. I'm thinking my two daughters received an overpayment. Shouldn't all three payments be the same?

Hi Melissa,
Your children may be eligible for benefits based on their father's work record and disability status as well, so the SSA may have factored that in to calculating your child's benefits. You may want to contact your local SSA office.
My ex gets disability and there for our two children get money each month from that. My question is does my ex still have to pay child support?

I really could not say as child support laws vary by state, so your ex's child support obligation may change due to his disability benefits.

Child support laws vary by state, so I really could not say if she is entitled to child support. We are not affiliated with the SSA nor are we affiliated with the federal government in any way.
If I receive ssi. (Not sure which it is I receive my money on my card the 3rd of each month, so is that ssi or ssd?) My question is if I receive my money the 3rd every month and my son does not, am I able to claim him on MY TAXES? And I will (if I am able to also claim head of household)

We are not tax experts, so we really could not say if you'd be able to claim your child on your taxes.
My husband receives SSDI, I am his representative payee for him and our children's benefits. (They receive under his SSID, they are not disabled). My question is, If I am contemplating divorce, how will that affect my children's benefits? Will they still receive what they are currently getting without interruption of benefits? What about myself, am I entitled to any payment? We have been married since 2002?

Hi there,
You may be entitled to benefits, and the children's benefits may not change. However, divorce law varies by state and as such your state's laws may affect your benefits.
Hi I applied for ssd in 2012 after getting sick. My daughter was going on 16 at the time. After processing and receiving ssd my daughter was 18. I received all back pay but none for me daughter. She has Been enrolled in school full time and I currently in college(she is 20 now)Are these Funds entitled? Is there any way to still recieve them?

Hi Ann,
SSDI auxiliary benefits may stop at 16 and as such your child may not have been eligible.
Hello. I am disabled veteran recieving 100% from the dept of veteran affairs. I was recently awarded ssdi...my question is...I pay child support that is calculated out of my veteran payment..if i apply for ssdi benifit for my son will that offset my monthly payment or will she just receive my payment along with a ssdi check for our son?

My husband receives SSDI. His ex-wife and he had a child. The ex-wife receives an SSDI check for this child check because of my husband. If he is concerned about the paternity of this child, what steps should he take to have this child removed from receiving his benefits?

Hi there,
your husband may need to establish that he is not the father before the SSA would stop sending the child auxiliary benefits. However, there would be no change in your husband's benefits as the auxiliary benefit is separate.
I adopted my brother's two daughters; one at only 5 days old. He just called and told me he got approved for SSD, and he wants me to collect for the girls (he feels bad for all the grief he and his significant other has caused us...and wants to support his girls in some way). At any rate, I told him that I'm pretty sure that we cannot collect since we have adopted the girls. I kept their last names (with the exception of adding my husband's last name to the newborn baby girl, so she has both, my maiden/brother's last name and my husband's last name).
Are the girls able to collect SSD from their biological father even after being adopted?
