I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?
I receive ss disability I have custody of my grandson is he eligible for benefits too

Hi Delores,
If you have grandchildren or step-grandchildren whom you are raising, they may be eligible to receive SSDI benefits the same as your child would.
If you adopt your grandchildren, they do not need to meet the above requirements. They would be covered as children because they were adopted.
Best Wishes,
Eric

Hi there,
The SSA may pay the same amount for all three children, you may want to contact the SSA regarding this.

Hi there,
Your children may not be eligible for benefits based on your spouse's work record if they are not considered your spouse's children by the SSA.

Hi there,
Your child may be eligible for benefits based off of her stepfather's benefits, you may want to contact the SSA office in your area for more information that would be specific to your case.

Your friend may want to contact the office that handles disability benefits in the state, as they may have information about receiving benefits as a caretaker.

Hi there,
Your children may be eligible for back pay, and they may not be eligible for benefits past the age of 18 for auxiliary benefits.

HI Lisa,
Your 18 year old child may become ineligible for benefits due to age.
Due to error on the part of SS-my children are now receiving back-pay under my husband's SSD. The representative whom he spoke with stated that there are restrictions on what we can use that back pay for-but everything I found online pertains to DISSABLED CHILDREN and using those funds for impairment related expenses-of which my children aren't impaired; so what CAN we use that money for? Does it have to sit until they age out of the child benefit and then we/they get it? We are temporarily living with inlaws and would have liked to use some of the $ towards a down payment on a house (2 boys-age 10 and 6 and 1 year old girl sharing a room). The idea of having some money when they are college age is nice but with our current financial situation it would benefit us all NOW. Has anyone experienced this/been able to use the $ for non dissabled dependents in a reasonable way like this?

Hi Debra,
Your children may be receiving SSDI auxiliary benefits, which are distinct from benefits based on their own disability, and is not subject to the same restrictions as benefits for disabled children. You may want to contact the SSA to confirm that is why they are receiving those benefits.

My sons mother has been collecting his social security disability benefits for years and I just found out. There is nothing in a custody agreement saying she can do this. I also pay her child support. We have a 50\50 time share. Why is she able to receive his benefits? Why was I not notified of her receiving them? Can I have the court order her to stop receiving it, or stop my child support if she is going to continue to receive this?

Hi Brian,
I'm not sure why you were not notified, however child support laws vary by state, so you may want to consult your legal counsel regarding this matter.
