Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

Hi Lataushia,
You may want to contact your local SSA office, they may be able to point you in the direction of some local resources for you.

Hi Chantelle,
Every application is considered on its own merits, so it's really hard to tell how long an application will take. Good Luck!

I was approved for ssdi in October 2016. My benifits started in December. On 12/15 I applied for benifits for my kids. Ssa has told me they will be processed by 2/13. My question is how long will it be before I receive their portion of my back pay? I received mine on 12/14

Hi there,
If your children are eligible, it may be as soon as your benefits were paid for your own claim.

Hi Tammy,
I really could not say as child support laws can vary by state and as such we would not have state-specific information.

My ex gets Social Security Disability and our biological child gets a monthly check. My current husband wants to adopt my child and my ex has no problem with it. Will that stop the benefit for my child?

Hi Sally,
It may not stop your child's benefit check if he is still otherwise entitled to it.

Hi there,
You may want to contact the SSA regarding this, but the SSA's criteria for who would be considered a child allows for children who are not biological children to receive benefits based on their parent's work record.

Hi Tina,
Your child may be eligible for benefits from the time that the SSA had determined that your husband was eligible for benefits, so he may receive back pay for then up until now.
