Waiting for decision

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

I had my hearing with the ALJ judge Oct 19,2016. The judge said you can't do your old job and you can not work. My lawyer told me when we were outside the courtroom that was a good sign and I would get a favorable decision. I called the ALJ office to get a status to my case on Mar17,2017 . Seeing as I hadn't so much as received anything in the mail or updated since my hearing. I was told it was the decision writers you'll recieve something within 4-6 weeks. I login in social security's website today on mar 22 2017 your claim for disability benefits has been denied you 60 days to appeal . WOW!!! Go from yes to no that easily

My hearing was on Monday. My question is if I get denied how long would It be before i get another hearing date take? My first hearing date took 2.5 years

Hi Nena,

It all depends, it could take up to a couple of years as well. The best thing a disability applicant can do to speed up the Social Security appeal process is to make sure they (or their representative, who can be a disability attorney or a non-attorney representative), file their appeal quickly if they receive a denial notice. Just by doing this, an individual might shave off three or four months of processing time.

Good afternoon!

I'm 50 years old I filed for SSD last May of 2016, I've been denied twice, I hired a lawyer and now I am waiting for a hearing. After a back surgery my body function is not like it used to and with the medication I'm taking I fee l weak. I don't take my medication when I have an appointment because majority of my medication makes me so sleepy and very drowsy. Getting up in the morning is very hard I feel so weak from the medication I took the night before and my legs are numbed and tingling and same goes to both of my hands. I'm suffering from carpal tunnel on both of my hands had Posterior Laminectomy and fusionC3-C6, I can't turn my neck like I used to, looking left and right is so difficult. Looking down is abearable because it so painful on the back of my neck. My hands feels theres sharp needles poking my palm and it suffer from spasm. if you been to Costco from the entrance to the meat department kills my back before I can walk 3-4 miles 2 times a week. Standing up for a period of time pain radiates from the midback and all the way to my feet.

My question is...
1. Now that I'm 50 is it easier to get approved from SSI. With these issues.
- My previous job was a CNA/medical Assistant and a cashier.
- I wear a brace on bought of my hands because of my carpal tunnel.
- I take medication that makes me so drowsy and that medicaton is to be taken 3 times a day.
- just did an MRI the result showed a pinch nerve on the lower extremities.
- had a posterior laminectomy and fusion
- having numbness and tingling with a sharp shooting pain from my back all the way to my legs

Do you think when they received additional medical record and new findings about my health do you think I still need to go to a hearing?

Hi Millie,

I am so sorry to hear that. Every case is different, so I can't say for sure if turning 50 will make it easier to get approved for SSI however. I will say that having more medical evidence to back up your claims the better. Wishing you nothing but the best.

I had a hearing after 3yrs the same day judge said I've made my decision we will mail you a letter is this positive, sign bench decision

My therapist went to the hearing disablity case on my side totally the the judge said she didnt have to talk the ve to determine the case.

My hearing went well with the therapist the the judge had no further questions for the ve to determine the case and my case is processing at the original social security spot

Hi Rebecca,
I really could not say as underwriting is just one of the stages of the process, however the fact that it's at the underwriting stage does indicate your application is moving forward through the process, rather than being denied at an earlier stage.

Thanks... Im praying it's a good thing.. I just don't understand why they contacted my lawyer for.. Also is it normal for my lawyer to say for me not to contact them for any updates?

Hey I had my hearing the judge didn't need to further questions for the ve I have proof I have been on 7 meds since 2006 the judge didn't need to do sga to decide it my therapist went judge ask her to send in her documents I been wait ing for bout 80 days the paper was write and sent to the judge already I suffer from scypoiarnia the thepist said paranoid

I went to court before a judge on Jan 17 2017 the the guy that's says you can do other jobs said I couldn't so do I have a good chance at getting approved I have not yet received any letter an they said the judge has made a decision an its been over 2 MTS do you receive a denial letter quicker than a approval letter

Hi Tammie,

It's tough to say that for sure because every case is different, but in general, those who are denied benefits receive their notice fairly quickly because they have to meet the 65-day deadline for filing an appeal.
