I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?
Hello. My step daughter currently receives SSI benefits through her biological father. She is turning 18 but still in school and wanting to change her last name to our last name. Will she loss her benefits its if she changes her last name to her moms? Thanks you.

Hi there,
You may want to go contact the SSA regarding this, but she may be able to keep her benefits even if she changes her name.
If my son's father which is disabled is incarcerated an his disability benefits have to stop will my son lose his also?

Hi Jessica,
If your son is receiving benefits based on his father's work record, then those benefits may not change even if the father is incarcerated. If your son is getting SSI benefits based on his own disability, then those benefits also may not stop.
I have two children with my ex husband. He has been trying to get disability (SSDI) for almost three years. He is expected to have a court date in the next few months. What I would like to know is if I have to apply for my children to get benefits or if they will automatically get them if he does? If I do have to apply, do I wait until he is approved or start the process now? I have been going a long time with no support because he can not even take care of himself, so I just want to know what might happen and what my next steps are.

Hi Amber,
Your children may be included in his application, but I really could not say if they are as I do not know the particular details of his case. If they are, they would automatically be awarded benefits.

Hi there,
You may be able to use your benefits to do so, it may be a good idea to contact the SSA to find out if you can do so.
My husband has ssdi and has a daughter from a previous marriage, he shares joint custody of his daughter with his ex wife, and his daughter receives ssdi benefits through him, however he hasn't seen her in almost 2 years and no phone calls just gets text messages, can his daughter lose her benefits for not seeing her father?

HI there,
No, the child may not lose her benefits because she does not see her father, however if you suspect the benefits are not going toward her benefits, you may want to contact the SSA and have them assign a new representative payee for the child.
My ex husband one his case for disability in June 2016. My ex husband has already received a big check how long does it take for our son to start receiving his checks? Are how do I go about this to find out.

Hi Robara,
If your child is eligible for benefits and was not included in the original application for benefits, then you can contact the SSA and apply for your child based off of your ex's work records.

Hi Glen,
if your grandson's parents are deceased or disabled, he may be eligible for benefits based on their work records.
My son is 7 years old and his father owes 28,000 in child support and he is waiting on a decision for his case going on almost 3 years I wanted to know will I get some back time if he get approved

Hi there,
if your son's father is applying for SSI, then you may not be eligible for back pay or benefits for your child as they are not offered with that program.
So my partner and i we got married in may and works for the va and he's a vet. And my ex wife has full custody I get visitation everyother weekend So my husband put them down has dependents cause hes their step father and he gets awarded 400 dollars amonth.it's one of the benefits he can get. Through the va. So that has nothing to benefits me or has nothing to do with me paying my child sapport. She doesn't like my husband to claim the kids on any benefits. Only she could because she has sole custody. So there fore no body can besides her. Is this true or false?

Hi Alex,
Child support laws vary by state, so the answer to this may vary based on where you live. However, if those benefits are intended to be used for the children, you may be committing fraud if those benefits are not used in that manner.
Our daughter gave us temp. custody of her 6 year old with a cognitive delay over 2 years ago with no financial support from her or her husband (he is not childs dad) Our daughter now gets disability checks (she is bi-polar and other issues) and I assume a check for the child. I found out by accident my daughter was approved for the funds. She still is not giving us any money for child, and child is totally supported by us and we are 65 and 64 years old, that just is not right. Is there anything I do? The checks are being squandered away.
I am currently on total abd permanent SS disability, I am becoming guardian for my two granddaughters, ages 5 and 3. Would they qualify for benefits thru ne?
