Waiting for decision

Submitted by Anonymous (not verified) on

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Hi Mary,

I am so sorry to hear, unfortunately this can be a very long process. Hang in there.

I am writing this on someones behalf. His processing time has been almost 900 days. He has been waiting for a decision for almost 1 year. The medical examiner says his impairments meet the criteria of the described impairments in the list of impairments and he has met them since his onset date and he continues to meet them. He has contributed more than enough to ssi. He has been evicted and is homeless with children and no money for medication shelter and food. His attorney tells him all he can do is wait. Does he have any rights? Who can he reach out to at social security or outside social security for help? I am in fear for his life and others he has confrontations with.

Thanks for the reply. He went to his local Social Security office and they apologized to him and said they've never seen a case decision still not be made after a year of waiting and they advised him to go directly to his congressman.

Hi David,

I just had my hearing July 18 2017. The VE said that there are no jobs that I can do.At the end of the hearing the judge told my lawyer that she does not need my medical record from a psych ward I was in and lawyer had not received. Can anybody give insight on what that means?

Hi there,
It seems like the judge had enough information based on what your lawyer and the Vocational Expert had presented.

The My Social Security site says: Disability determination Decision under review does this mean there is a decision made already?

HA, My wife has several diagnosis that fit the criteria. As well as some Auto Immune thing, they are calling Lupus right now, maybe MS, they don't know. Got a lawyer, been waiting for over three years. Finally got in from of a judge and she was denied. The judge had the audacity to say, "You husband works and provides insurance", three months latter we get the denial letter. We have 6,000 a year deductible, we lost our house, and I can't afford to send her to the doctors any more. The lawyer keeps asking us for more medical records to submit for the appeal. We have to tell him, we don't have any, can't afford any, lost our house. We don't even live in the same state this last appeal is going through. What a disaster. In the mean time I watch this dude I know from the neighborhood we just had to leave, he's got SSDI, has for years, nothing wrong with this dude, I watch him landscape, ride his Harley Davidson, wrenching on his cars, etc......Said his back is sore, got a doctors note and collects 2400 a month as well as medical benefits. So in other words, I paid of a scam doctor. The whole system is rigged. This has been going on for us since June 2014. What a travesty.

I had my hearing on 02/23/17 the judge sent a medical interrogatory physcial impairment with 9 questions to be answered. It was sent across the country for a neurologist to answer. She answered only one question and said that she could not come to a decision if I met the disability impairment for social sercurity. So now my attorney has asked her to review all of my other issues to try and get me approved. It has been almost six months since my hearing and I feel they are trying to find a way to say I do not qualify. Just a list of my issues, Stoke times 2, seizure disorder, congestive heart failure, a stent, coronary artery disease, diabetes type 2 insulin dependant, kidney disease, liver disease (non alcoholic), cronic venous insufficienty, anemia, diabetic charot arthropathy, fibromyalgia, arthritis, and an enlarged heart. I have gone through the adult disability listings and I have a lot that say I am disabled, so I don't understand why it is taking so long. Anybody else out there that has been waiting a long time?

I just received a letter from the supervisor at the hearing office and they wanted some updated information on me from my doctors for the last year and the letter stated to me and my lawyer they were going to try to get me fully favorable without a hearing but if they cant they would give me another hearing...I wonder if that is good or just a routine letter that others have received thanks for anybody's input....
