I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.
I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.
During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.
My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.
I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.
My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Hi DeeDee,
Every case is different and can take varying amounts of time. As of right now, it seems like the SSA is drafting the decision for your application, however they do not have someone actively working on the decision as of now.

Do you know how long it generally takes for a decision to be written up by a writer? A lady that I spoke with in odar told me 30 days. My decision has been in unassigned writing now for two months.. so frustrating.

I had my hearing on 6/01 and was approved on the spot dating back to 2011 and I just received my approval letter in the mail today. I waiting 1 year to get the hearing scheduled.

A hearing decision can take anywhere from 60 days to 2 years from my experience. It depends how many hearings are heard at the hearing location, how many judges they have. How many 'clerks' are assigned to each judge. You see, it is not them who are waiting for you but you are waiting for them. They don't tell you this but part of taking so long is in hopes they will 'starve' you out, weed out the fakers, so forth. Also a judge could have already made a decision but when it goes to be written, it could take a LONG time, then it has to be sent back and signed. Then sent to your lawyer, or local office. Its a nightmare!!!

It's so sad but I agree with everything you said about weeding people out. I've worked my ass off all my life up until I got sick and was taking off of work. I've been off work for 4 years now do to my health. I don't even do my taxes because I don't make any money. I'm starting to think I should do my taxes so the alj can see my earnings say "zero earnings" instead of it saying "not yet recorded". Been waiting 10 months for a decision. Homeless due to the wait time and I am ready to kill myself to end everything. Even my doctors can't believe I've waited so long.

Hi I'm from Texas and want to move state maybe Minnesota info a Ohio or Colorado. Can it affect me I already had my hearing on marcha and I called the ssi and they said it will take around a year for the decision can I leave state or will I have to start everything all over again ?

Hi Ali,
It won't affect you, because it is a federal program and not a state one. But you should let the SSA know that you plan on moving and changing addresses

I had my SSDI hearing last year, I've been waiting almost 10 months for a decision from the ALJ. I've been evicted and I'm living in a vehicle, health benefits have been cancelled, I have no money for food or medication and I have a child. My lawyer says there's nothing we can do and the ODAR keeps telling me it's with the judge under review. I can't take it, I'm ready to check out and kill myself! Even my doctors can't believe the ALJ is taking so long! I've worked hard all my life and have contributed plenty to social security to have more than enough work credits. It's very sad :(

I am awaiting my hearing with a judge and just received a letter saying to fill this out right away because they may be able to find a favorable decision so that I don't need to go to court. Kind of like a last chance. It's for ssd .what are the chances I get approved and then don't need to go to court. I've been waiting over a year and have went thru the process. Waited ng on hearing when this arrived.
How long does it takes for a notice of decision letter to come to you .. If it was mailed on June 27th

Hi There,
It's tough to say because every case is different, but usually those who are denied benefits receive their letter sooner because they only have a certain amount of time to appeal the decision.

You may still be eligible for benefits, however I really could not say what your chances are as we are not affiliated with the SSA and we do not have information about your case.
I asked the judge to subpoena my doctor 2 weeks before my hearing, and again a week before it. And yet, no doctor was there. I don't think she read any of my medical records or mail before the hearing. The assistant did though, and told me on the phone that the judge would call the doctor if she needed to prove it. Is this grounds for an appeal?
