I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.
I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.
During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.
My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.
I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.
My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Hi there,
Your age and ability to be re-trained for a different job greatly affect your ability to be approved for benefits. The "correct" answer would be the answer that accurately reflects your level of education.
My husband has been fighting this systems since 2008. Since we have a lawyer working the case they stated he can only go back as far as 2010 if he get approved for back pay. He was denied twice his last court hearing was in Nov. 2016. We are still waiting for the judge. No one can tell us anything the lawyer said that they do not know anything and we would know before them. I do not understand why it takes this long. Honestly is there something we can do maybe write a letter to someone that is over the judge like a congress man or mayor?

Hello,
It is a very long process unfortunately. A congressional inquiry could help your claim get approved though. If you are denied again your local congressperson could help.
Best of Luck,

I went for my mental evaluation on the 24th of April and was re-diagnosed by social security personnel. I called my local agent on the 15th of May and was told a decision was sent to what I am guessing is a department for decision approval. I called again this month June on the 7th and was given a number from my local agent to the department my decision was sent to. And they told me I was pretty much to wait for a letter in the mail. Everything up until this point has gone smoothly and considerably efficient. And I guess I understand why they are all so vague and just won't tell me specifics because they don't want me messing with the process. But does anyone have any idea how long it will take for this official decision letter to come in? I keep reading that if its a denial that they will get back to me fairly quickly within the 65 day appeal status deadline, and if that's the case I should be hearing from them by the end of July at the latest based on what I've been told. But how long will it take if I've been approved?

Hi Katie,
Unfortunately it's tough to pin point an exact time because each case varies. It can be a long process. Though. Best of Luck.

Hello to all,
I had my hearing on May 23, 2017. The hearing only took 30 minutes. My lawyer was present as well. There was several questions asked. at the end the judge told me that it usually take 6 to 8 weeks to have a decision, but he also said he will make his decision before that time frame. I have diabetes, which I take 4 shots a day along with Januvia and Metformin. I also have high blood pressure, sciatica nerve damage in my lower back that radiant down the back of my legs. I also have kidney stones that constantly comes back often, and must be treated with lipotripsy. I also suffer from Major depression, which I have been seeing a psychiatrist for about 2 years now, and I also takes medication for the depression. I also walk with a cane because of my feet. I take physical therapy for my feet. I have severe heel spurs that requires surgery, but the Dr id trying to make that my last resort. I would like to know do I have a greater chance of receiving disability. I would really appreciate the answers.
Thanks,
Sabrina

Hi Sabrina,
I am very sorry to hear that. However, it's tough to say for sure because every case varies. It helps to have a lawyer like you do and the more evidence you have, the better your chances are.

Thanks Eric for your response. Its been 43 days since my hearing.
I had my hearing for SSI on 4\12/2017 and it's been over 60 days and they keep saying the decision has been made and it has to be mailed haven't received any thing yet is that a good or bad sign

Hello,
It's tough to say for sure because each case varies. However, those who are denied benefits receive their benefits sooner than those who are awarded as they are only allowed a certain amount of days to appeal the case.
Best of Luck,
Eric
Hello, I had my hearing feb 23 2017. The hearing went well and lasted about 15 minutes. The ve was asked three hypotheticals from the judge. The ve said that I couldn't perform former work but he did list three jobs, including a bondsman. On the last hypothetical the ve said that I would have to miss 20% of work monthly. That would mean 5 days monthly. The judge then closed the record and said that I should receive the decision shortly. It's been four months. I called a month after my hearing and told it was in unassigned writing. I spoke with another rep on April 26 and she said that the decision was just made and it should be another 30 days. It has been two months since then and it is still in unassigned writing. I don't know what's going on.
