Who pays the attorney fees.

Hi there,
A Social Security attorney works on contingency. This means that if you don't win your case, your attorney won't get paid. If a claimant does win his or her case, the attorney will be eligible for 25% (no more than $6,000 though) of a claimant's back pay. Back pay is a lump sum that is given to applicants who waited more than 5 months to be approved. If you are approved quickly and are not entitled to any back pay, an attorney does not get paid. Social Security attorneys should NOT have any up-front costs, nor will they ever take a portion of your monthly benefits. I hope that clarifies things!
