I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?
Hi my son father was given full custody of him. My son moved with me his sophmore year in high school. I took care of him by myself. His father provided no support. His father passed away recently and we found out that he was getting ssi benefits for my son. My sons dad is married and has been since he was little. I never received any money from my sons father to care for him and never knew he was receiving benefits. Now that he is deceased is there anything my son can do to recoup the money taken? My son is 23 now and his father received this money plus back pay for 3 years before he turned 18.

Hi Elesha,
I really could not say, but it may be a good idea to contact the SSA regarding this as they can investigate any abuses in benefits.

Hi Cindy,
Please stay with us.
Your child may be able to receive survivor's benefits on your account, but that would depend on if you have sufficient work credits.
I have custody of my 27 year old daughters three young boys. Question she died 11/12/16 are they eligible for benefits?
In reply to I have custody of my 27 year by D.Marrero (not verified)
Hi There,
I'm very sorry to hear about that. They may be eligible for benefits based off of your daughter's work record, and it may be a good idea to apply for those benefits as soon as possible, as the SSA may not pay those benefits retroactively.
My son's father has been receiving SSD benefits for 2 years, I just found out about it and wanted to applied for our son. My son's father stated if I apply it will effect his monthly benefit income. I's this true, and how long will the process take if there are other child that needs to apply?

HI there,
If you and the father do not have any financial ties to each other, it may not affect his benefit amount. The time it takes to apply varies as every case is different. It may be a good idea to contact the SSA for more information, you can contact them at 1-800-772-1213
I found out recently that my daughter's biological father is collecting disability benefits. He is NOT on her birth certificate and paternity has NOT yet been established. My husband wants to adopt my daughter but if he does would that disqualify her from ever being able to receive supplemental benefits from her biological fathers SSDI?

Hi there,
Adoption may not disqualify your child from receiving benefits if she is otherwise eligible to receive them from her biological father's work record.
My son is currently on ssi and Medicaid he is 3 and permanently and fully blind along with another metabolic disorder which requires very frequent expensive meds . I am engaged and the man I'm marring is not his biological father and he makes decent money. My question is, if I marry him will my son lose his benefits?

Hi Mary,
Your child may become ineligible due to meeting income and resource limits, however I really could not say for sure.

Hi there,
you may want to contact a disability advocate or attorney. They can fight for your son's benefits, and in the case of the attorney, they could even bring it to federal court if needed. You can reach out to one by filling out this form:

My ex husband started receiving ssdi after we divorced. Our son who is now 9 has been receiving benefits on his behalf. I have sole custody of him.I got a letter that said he was overpaid and what my son received needs paid back. Is he responsible for the payback?

Hi Francie,
You may be responsible for the income--I would strongly recommend calling the SSA at 1-800-772-1213 to get to the bottom of this!
I was not approved in September. I file for an appeal in late September. Got a lawyer, now just waiting. I have a 16 year old in high school. And also married, but separated. And have been since 2007. Living in separate cities also. What will be the amount then if approved?

Hi Robin,
It's impossible for me to know, but you can use our calculator to get a good estimate! http://www.disability-benefits-help.org/form/disability-benefits-calcul…
Hi, my daughter is 16 years old and just started getting disability, will we still get child support from father? Perth Western Australia. Thank you
In reply to Hi, my daughter is 16 years by Nikki (not verified)
Hi Nikki,
This is very hard to know for sure--usually, child support is determined by Child Services, not the SSA.
