Qualifying children

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

I'm 19 now an my my dad owes alot of back child support for me and my brother who has now passed but my mom never received any for us nor did my grandparents. My dad now gets disability is there anyway for me to get compensated or any benefits so I can get through school and help take care of my babies?

Hi there,
I'm not really sure how you would be able to receive that, child support laws vary by state and so I really would no know how you could be compensated for back child support.

My wife and I have had permanent legal custody our 16 year old granddaughter since 2003 and I am receiving ssdi. We have not heard from her biological mother since then and unknown where she lives. Father is incarcerated for life and we have never received child support from them. Is our granddaughter eligible for SSDI benefits if she is not adopted but has been our legal dependent since 2003 ?

Since you have legal custody of your 16 year old granddaughter, she is eligible for SSDI benefits until she is 18 years old.

I went to the social security office today in Seminole County, FL and the lady behind the counter told me my granddaughter dosent qualify because she is not adopted. Should I go to another Social Security office and try there?

Hi David,

Grandchildren are a type of dependent family member that are eligible to receive auxiliary disability benefits based on the work history of the grandparent in question:

To be eligible, the grandchild must completely meet the following qualifications:

-The grandchild’s parents are deceased or also disabled
-The child had been living with the grandparents before they turned 18 years old
-In the year before the grandparent was eligible for SSDI benefits, the child received at least half of his or her financial support from that grandparent.

hi i was wondering if my boyfriend lives with me and i have 2 disabled kids on ssi will that affect it, we are not married and he is not the kids father. He works odd jobs and we live in mass.

Since you and your boyfriend are not married, your children's SSI will not be affected.

I currently receive SSDI and I'm interested in applying for auxiliary benefits for our newborn son. My wife is currently employed and I've been receiving conflicting information regarding whether her income plays a role in receiving auxiliary benefits for our son. Does her income in any way affect this decision? Thank you.

Hi Edwin,

If you're getting benefits based off your work record (SSDI) then your son will be able to receive auxiliary benefits. Your wife's income will not effect it in any way.

My ex has been receiving long term disability thru his employer. His child support payments have been taken out of these payments. He finally won his SSDI and received a lump sum payment. His support is now coming out of his SSDI benefits. I filed a claim for our son and are waiting to hear from social security on his benefits. I was told he is eligible for a lump sum payment and monthly payments until he graduates. He just turned 18. My ex informed me that he has to pay back his long term disability he received from his employer and he has asked the courts to take the child support he paid out of our sons lump sum payment. (He has yet to receive any $ from SSDI) Social security informed me the money will go directly to our son as he is 18. Will I still be expected to pay back the child support when I am not getting the benefits and my son is?

Hi there,
Child support laws vary by state, so I really would not be able to say whether or not you would owe that money. You may want to contact the office in your state that handles child support.

my children father receives ssi he was just called in for further review he is 24 been receiving ssi since he was 10 years old.he just applied for disability also I'm thinking ssdi he gave them his children name and their mothers he has 4 children the ssa told him a decision will be made within 90 days but he still receive ssi he was told he would receive 800 monthly if approved.will our children get benefits?2 of them already receive ssi they are disabled the othe 2 dont

My ex-wife's only income is SSI disability. Our 11yr old son get Medicaid. If I claim him on my taxes will it affect his Medicaid? We only have a verbal agreement on joint custody but he lives with her and I pay $100/mo child support which is probably not reported.

As Medicaid is administered on a state-by-state basis you may want to contact the office in your state that handles Medicaid as they can give you detailed information about their policies.

if he's receiving SSDI auxiliary benefits based off of your work record, he may be ineligible for those benefits after the age of 19.

I have legal custody of my 13 year old grandson. I am 61 years old and have had custody of him since he was 4. I have been on disability for around 8 years. His mom also receives a disability check but she does not have custody of him. Can he draw a check also??
