I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?
If you sign over your parental rights can that child still be eligible to receive benefits?

If you are no longer legally considered the child's parent, it is doubtful that they would still be eligible for benefits based off of your work record.
Im now in my 30s. My father has been receiving SS Disability since I was a child. He went through years of paperwork to get back pay he claimed he was owed. About 10 years ago, he received checks in our (his adult kids) names. They were different amounts with mine being around $3,000. My sibling recently told me he got checks again. Last time this happened he told us the money was his and asked us to cash the checks and give him most of the money, which we all did. Why is SS sending him the checks when we are all adults now. I'm 34! Is he obligated to turn these over to us? What can happen if he doesn't? Can I call SS and get info about this? None of us kids are or have ever been disabled. It seems this money is dependent back payment.

How do I legally find out if my ex husband received his disability? We have a minor child that I have legal custody of.

You would need written consent from your ex-husband to find that out, as the SSA keeps that type of information confidential.
I already recieve disability. I'm pregnant and not sure what steps to take now? Will the baby receive benefits? How do i start the process??

If you get SSDI benefits based off of your own work history, your child may be eligible for auxiliary benefits based off of your work history.
Hi my son 27 has brain cancer and recently got SSDI approved for Feb 2016..He has 3 children 6yr old and twins 3. SS took application for the kids at same time as his app..The primary custodial parent is the Mom whom they live with. He recently because of the illness moved back with me Mom and Dad..The kids are his biological kids and have his name although he is not married. Do these kids get benefits? and if so where does the $ go to my son as a payee rep? or to the Mother? If it goes to him does he give over the $ to Mom in a money order? We want to make sure it is used on the kids. My son just got his first SSDI ck for feb-March..and his letter of approval-nothing yet for the kids-or did the Mom get the letter? He also didnt get the retroactive check yet. Hes very ill with all these chemotherapy treatments..Thanks

I'm sorry for the situation your son is in, it must be a very trying time for your family. To answer your questions:
Yes, any auxiliary benefits(from their father's SSDI benefits) that your grandchildren get go directly to them. However, they would need a representative payee. It does not need to be their mother or father, it can be another person that the SSA believes would use the benefits responsibly for the children. Since the money is for the children, the payee is only obligated to use it for the children themselves. Also, the SSA only accepts auxiliary benefits applications after the approval of the first SSDI application. So you may need to apply for the children again. I would contact the SSA for more information, their number is 1-800-772-1213 or you can also go to www.ssa.gov .

Hi Heather,
I'm not really sure how you can file your taxes, I would get in touch with a tax professional to find out how you can file. However, the check that your brother draws off your father would relate to your brother's taxes rather than yours.
I receive ssdi and my son receives auxiliary benefits from me . His father lives with us and helps financially as well. Can his father claim him as a dependant on his taxes? We are not married! Thanks

I'm not sure if your son's father could claim your son as a dependent, but as far as the auxiliary benefits go, those should not conflict with your son's father's tax filing as the auxiliary benefits would be your son's income. Regardless, I would consult a tax professional about what to do regarding taxes.

Hi Jessica,
Backpay would really depend on if your children were listed on the initial application, and the benefit amount you would be able to get would depend on your ex's work record if he is getting SSDI. If your ex is getting SSI, there are no auxiliary benefits available for SSI receipients.
My son is 41 yrs old with cancer and now, the doctor said both of his eyes are officially blind. He's getting ss but someone said that he can get more if he reapply for SS. Is this possible?

If he is eligible for SSDI and has applied only for SSI, then yes, he may be eligible for more money based on his work record. You should contact the SSA to both let them know if his condition has worsened and to also find out if he is eligible for SSDI.
