I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?
If my childs father is getting a lump sum from ssi and owes over 60,000 in child support, would I receive anything?

Hi there,
It's possible! But child services is the organization that deems whether or not SSI or SSDI benefits can be used in lieu of child support. I am afraid I am unable to answer that question for you.

Not unless the back pay was more than $26,000.
We have been raising my grandson since nearly birth I have had custody of him since approximately December of 2013 is he eligible for up to 50% of my husband's disability or Social Security benefits

Potentially. You either need to legally adopt him, or his parents need to both be disabled or deceased.

No, no auxiliary benefits are available for people on SSI benefits. Your daughter would need to be disabled to get benefits.

My children's father was recently approved for social security disability with June 2012 as his date of eligibility. My oldest daughter was 15 during the month of eligibility. Today, she is 19 and a full time student. Will she be eligible for back pay benefits?
I have been designated as his representative. I take care of him and allow him to have his own room in my home to be near his children. Otherwise he would be homeless. Will his benefits be effected by my income? My relationship to the disabled is that of a caretaker.

Hi Pam,
Your daughter may be eligible for back pay if your children's father is receiving SSDI. If he is receiving SSI benefits, then the material support you provide for him may be used to calculate his benefits.

SSDI benefits are not taxable unless you're earning more than around $26,000 per year.

If their mother is getting SSDI benefits, then you may be able to get auxiliary benefits for them based off their mother's work record.
I filed my mom for disability in April of 2009 when she had cancer. I was 26 and had a 15 and 16 yr old brother and sister. My mother had custody of them and they lived with me and my Grandmother (my mom did as well.) My mom died before her disability was approved and my siblings father filed for emergency custody of them and ended up getting all of my mothers back pay and my siblings when they lived with me while she was sick. He was never even around them most of their lives and he blew the money on frivolous things. He never even offered to pay for her funeral. This seems illegal to me. Isn't this fraud? The money, especially my mothers back pay, should have went to me, being her oldest child. How did he get her money and aren't their laws to protect people from having this done to them?
My son was recently approved for SSI and I cannot receive it due to them saying because I'm still married and my ex has a house that is over income what dose that have too do with my household and my son's health ...we are still married and he lives with his dad and his house his uncle has been in That house from the 90s before I even came into the family so where do I go from here .....his mom left him that house when she passed could he give the house too another family member and I could be approved and they also said that I could be penalize for up to three years where do I go from here where do I go from here

Hi Ashi,
Because you and your ex are still married, both his income and resources and your income and resources are used to determine eligibility. Your ex may be able to transfer the house, but I would not be able to say how that would affect eligibility beyond the fact that the house may not be counted as a resource for SSI benefits at that point.

Hi Luke,
Yes, you would be able to work while your child receives disability benefits, but if they are getting SSI benefits you would be subject to income and resource restrictions.
