Waiting for decision

Submitted by Anonymous (not verified) on

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

Eric

Hi Buddy,

I am sorry to hear that. You may want to check in with the SSA and see if they have any updates. Wishing you nothing but the best.

Has anyone ever had a case in prehearing review? My case was sent after I faxed a copy of my drivers license indefinite suspension die to med condition. Is a pre hearing a good sign? This will be my 2nd time filing, lawyers did it all this time.

I had my alj hearing in Dallas North Odar office on May 9th,2017. Judge made decision on May 10th. It has been with decision writers ever since. My lawyer says the lack of decision writers has created a big backlog of cases. It's been 5 months. They have told my lawyer you will get your decision when you get it. The backlog is in every state.

After reading all these, I'm starting to be grateful of our situation. My husband got denied first time and got a lawyer. Waited about 15 months before getting a hearing with the judge. Hearing was August 2 2017. The judge told us he was going to approve him during his hearing, but they were so back logged it may take 5 months or longer. Well, we called out of the blue to check on August 2nd 2017 and by some miracle they told us the judge had just signed off on his, fully favorable, decision. A letter went out the October 5th 2017 and we got it a few days later. Now, since he's only getting SSDI I'm assuming it went straight to the payment center? We tried going to our local office, the gal was no help at all. On the phone they said it would go to our local office, but the lady at the local office said it was with the payment center. Is that a good sign? I'm praying it goes just as fast through the payment center because we're at the end of our rope.

I had my court date in April 2017, Alj missed the fact that I have a qualifying condition and denied my claim. We appealed and promptly received a letter from the appeals counsel requesting an update on medical records and reason for appeal. My question is does anyone have any ideal how long the appeals counsel takes to review cases? Is it a good sign that they requested an update quickly or just a freak thing?

Hello,
My question is , after the wait of 4,5, 6 months for a decision post hearing, do any of the people got a favorable decision. Does a long wait associated with denial or unfavorable decisions.

HI Adam,
Every case is different, and so it can take a varying amount of time for a decision to be made regarding your case.

A decision was supposed to be made on October 13th. I've already been denied, I have Lupus, Atrial Fibrillation, 2 Strokes, and now I have to see a Neurologist because my hands and feet "fall asleep" like the circulation is cut off. I simply cannot work!! I worked mostly as a Carpenter and I can partially close my hands! Anyway, it's past the decision date and they still can't make a decision!?

My car was repossessed, but I can't grip the steering wheel to drive, I've sold just about everything I have, I can't borrow from family anymore so I'm ready to lose my apartment, the local church can only help with one months rent a year, yes I go to the food pantry, but I'm so damned depressed and sick to my stomach that I can't eat anyway! I've worked 32 years and I am going to wind up on the streets!!! I can't even afford all my prescriptions!!! This is what we pay into all these years, and when you really, really need it you can't get it!!! I can't hold on much longer!!!!!

Does having an attorney help your disability case?

I went to my hearing last week, the odar office says the judge made a decision and it is with the underwriters. When I reviewed the CD from the SSA office, immediately after the hearing it was sent to them (the underwriters), does this mean I did not get approved?
